Dismissal or Demotion Letter
This Dismissal / Demotion Letter is used where an employer has decided to dismiss an employee, or impose some other sanction short of dismissal, because the employee has failed to improve their conduct or performance.
It is intended for use at the end of a disciplinary process where the employer has concluded that further formal action is justified.
When to Use This Dismissal or Demotion Letter
Use this letter where an employee has not achieved the required improvement in conduct or performance and the employer has decided to dismiss or apply another disciplinary sanction.
It should only be used after an appropriate disciplinary procedure has been followed.
Important Legal Point on Demotion or Other Lesser Sanctions
This letter must only be used where the employer has followed an appropriate procedure in accordance with the ACAS Code of Practice.
❗ Alternatives to dismissal, such as suspension without pay or demotion, must only be used where there is a contractual right to impose that sanction.
