These Yoga/Pilates Membership Terms and Conditions (Group or Individual Sessions: Per Session/Package Bookings) are designed for use where a yoga or pilates instructor runs a yoga/pilates studio and teaches either a large or small group or an individual client. This template differs from the accompanying Yoga/Pilates Terms and Conditions (Group or Individual Sessions: Per Session/Package Bookings) in two respects:

(a) This template provides that clients must become and remain members of the yoga/pilates studio in order to attend any sessions; and

(b) These terms are written with larger groups in mind (e.g. six or more clients at a session) but by choosing the appropriate optional wording in the template, these terms may easily be adapted for teaching either a smaller group or an individual client.

This template is not suitable for teaching of any other form of fitness exercise or any type of dance.

Whatever the size of the enterprise providing yoga/pilates teaching, this document can be used. Typically the provider will style itself as a “yoga and pilates studio” and it will be a company or partnership. It will engage teachers/instructors to take sessions for it, and the studio will contract with each client on these terms and conditions. However, these terms may also be used by a provider who is him/herself the only yoga/pilates teacher (operating as a sole trader) in which case he/she will contract personally on these terms with each client who books any session/s.

These terms require each client who participates in a session to be and remain registered with the studio as a member of it before booking any session. The template provides for clients to pay a membership fee for each quarterly period or other period of membership.

In addition to the membership fee, the client also has to pay a fee for each session that he/she books. These terms provide that each session may be booked and paid for by the client as a single session or, if the client prefers, instead as part of a package of sessions. This document requires each session, whether booked and paid for as a single session or as part of a package of sessions, to be booked for a date within a limited time after payment is made.

Where clients book a package of sessions (typically 4-10 sessions) rather than paying for each session as a "one-off", you will receive payment upfront for the whole package. Your pricing can encourage booking of packages by offering a discount for a session if it is paid for as part of a package. However, if you only wish to allow payment and booking of sessions individually, not as part of a package, this template can easily be adapted by deleting the appropriate words which appear in square brackets.

Designed to be as flexible as possible, this template contains a number of optional clauses and/or phrases. Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so that they are compatible with one another. Unused options should be removed from the document.

These terms should be used only where the client booking a class is a “consumer” as defined in the Consumer Rights Act 2015 (i.e. an individual who receives services or uses facilities for his/her personal use and for purposes wholly or mainly outside the purposes of any business of that individual or another). The terms are suitable for use where the contract is an “on premises”, “off premises” or “distance” contract as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The Regulations require you to supply certain information to clients who are consumers before they book any class/es. Where the contract is an “off premises” or “distance” contract, the Regulations also confer on the client certain rights to cancel the class/es booked and we have set these out in the terms themselves.
