Businesses often choose to forego the expense of buying large numbers of tools since many only infrequently undertake building and other work. Hire is therefore often the preferred choice.

This Tool Hire Terms and Conditions (B2B) template is designed for use by businesses which hire out tools and light plant to companies or businesses. It is for use only where the hire business’s customer does not act as a “consumer” in relation to the tool hire.

However, where the customer of the hire business is acting as a “consumer”, we have provided an accompanying alternative set of terms, the Tool Hire Terms and Conditions (B2C).

The term “consumer” is defined in the Consumer Rights Act 2015 as an individual who receives services for his/her personal use and for purposes wholly or mainly outside the business of that individual or another.

Detailed terms and conditions have been assembled in this document which govern key factors ranging from hire term and fees to the customer’s use and care of the hired equipment. This template also includes provision for an up front refundable deposit to be held as security against loss, theft or damage. There is also provision for an optional accidental damage waiver.

It is important to note that this document is not designed for hire of heavy plant and machinery. In some cases businesses which supply a wide range of small and large equipment may require separate terms and conditions for different categories. Specific terms and conditions for use with such equipment are also available.
