Designed for the hire of scaffolding and erection of the scaffolding by the supplier, these Scaffolding Hire Terms and Conditions (B2B) cover a range of important points to allow for smooth and efficient transactions between a scaffolding hire business and its customer.
This template is for use only where the hire business’ customer acts in the course of a business and does not act as a “consumer” in relation to the scaffolding hire. “Consumer” is defined in the Consumer Rights Act 2015 as an individual who receives services for his/her personal use and for purposes wholly or mainly outside the business of that individual or another. (A consumer - typically a householder having work carried out to their home - will not hire scaffolding: their builder would instead do so to enable the builder to carry out the work for which it is engaged by the householder.)
This document is designed for use only where the scaffolding is hired out, delivered, erected and dismantled by the hire business or its contractors.
Customers are subject to a number of obligations to ensure that the site will be accessible, free of obstacles, fit for use and that no damage will be likely to occur.
Payment in this terms and conditions template takes the form of an initial deposit, followed by the balance of the hire fees and a refundable security deposit.
Cancellation provisions are included, allowing customers to cancel within various time windows before the hire period begins. For each window, different refund and/or payment terms apply, ensuring that the closer to the hire period the cancellation takes place, the more money your business is entitled to – reflecting the level of inconvenience and loss of opportunity to hire the scaffolding out to a different customer.
Customers might damage hired scaffolding items, whether accidentally or otherwise. Provision is therefore made for an accidental damage waiver. Damage (or loss) outside of that waiver is the customer’s liability and it should be covered by the aforementioned security deposit and insurance by the customer.
Please note that while this template can also be placed on a website for hire to non-consumer customers only, it is not designed to serve as terms and conditions for e-commerce and has not been written with e-commerce laws in mind.
