Domestic Garage and Car Parking Agreements

The documents below can be used to let a parking space or garage to a person for private, as opposed to business, purposes. The user may park a car there or, in the case of a garage, use it for the storage of household items. 

As the leases are to be granted for non-business purposes, they should not be “business” leases and should not therefore attract security of tenure under the Landlord and Tenant Act 1954. For that reason, the lease templates do not include clauses excluding the tenant’s right to security of tenure. Depending on the location of the garage or parking space, the landlord may be able to charge a significant amount of rent. Regardless of the level of rent, however, it is essential to have a written agreement between the owner and the user. If practical matters are considered and documented at the outset, this should reduce the scope for disputes during the term of the lodger agreement.

If you need to let parking or a garage to a business, use a bare land or industrial lease or licence instead, which are drafted for that purpose.
Will the user get security of tenure like a business tenant? +
No, provided the use is genuinely private. Security of tenure under Part II of the Landlord and Tenant Act 1954 applies to premises occupied for business purposes, so a garage or space let purely for private car parking or household storage falls outside it. Because there is no business occupation, these templates do not need clauses excluding the right to renew.
Do I need a written agreement even for a simple parking space? +
It is worth having one whatever the value. A short written agreement records the rent, the permitted use, the term and the notice to end it, so both sides know where they stand and disputes are less likely. Depending on location a garage or space can command a significant rent, which makes a clear written record all the more sensible.
