New Written Statement Requirements
The Assured Tenancies (Private Rented Sector) (Written Statement of Terms etc and Information Sheet) (England) Regulations 2026 require landlords to provide a detailed written statement of terms to include:
- The amount of rent payable and when it is due.
- If the rent amount includes utilities such as Council Tax, electricity, gas (or other fuel), water, sewerage, tv licence, communication services etc. you will be required to give the certain information for bills that will be covered by the rent which the tenants must pay you separately for.
- A statement explaining that if the landlord makes a proposal to increase the rent under the tenancy, that they must serve a notice in accordance with Section 13 of the Housing Act 1988.
- Statements from the landlord confirming compliance with Section 9A of the Landlord and Tenant Act 1985 in relation to fitness for human habitation and Section 11 of the Landlord and Tenant Act 1985.
- Statements from the landlord confirming compliance with electrical safety and gas safety standards and regulations.
- Where section 190 of the Equality Act 2010 (improvements to let dwelling houses for disabled persons) apply a statement to confirm compliance.
- Details of the new rules concerning pet consent.
- Details of the minimum notice period a tenant must give when giving a notice to quit the property.
- A statement explaining that in most circumstances the landlord can bring the tenancy to end by obtaining an order of the court for possession of the property and the execution of the order. To apply for the order, the landlord is required to serve on the tenant a notice of proceedings in the prescribed form and specify the ground(s) of possession, with the notice period depending on the ground being used. Some possession grounds will require the tenant to be served with prior notice; these should be confirmed.

Existing Tenancies (Pre-May 2026)
Written tenancies granted before 1st May 2026 do not need to be replaced. Existing Assured Shorthold Tenancies (ASTs) will automatically convert into periodic tenancies. However, landlords must provide tenants with a prescribed Information Sheet by 31st May 2026. Failure to comply will result in a fine of £7,000.

When These Templates Are Not Suitable
Some lettings fall outside the scope of the Housing Act 1988, including:
- Lettings to companies or other non-natural persons
- High value properties (where the annual rent exceeds £100,000)
- Lettings where the tenant does not occupy the property as their only or principal home (e.g., a second home)
- Resident landlords.
