Domestic Garage Lease

This Domestic Garage Lease should be used where the Landlord is granting a lease of a garage that is to be used for storing domestic vehicles or household items. If the garage is to be used for business purposes, this template should not be used. Please refer instead to the templates in our Industrial Leases and Licences Group.

The lease grants the Tenant the right to exclusive use of the garage and (optionally) a right of way over any land owned by the Landlord which gives access to the garage.

The Tenant is to pay a monthly rent. No mention is made of council tax, business rates or utilities charges. If any of these apply to the garage, the Landlord must make sure that the rent is sufficient to cover these outgoings.

The lease has a fixed Term which can be brought to an end early by either party giving notice as set out in clause 4. The Term should not exceed 7 years as such a lease would be subject to compulsory registration at the Land Registry and would need to be in a different form. In practice, Landlords will often keep the lease term fairly short (e.g. a year) and then renew the lease if the arrangement is working well. The renewal provides an opportunity to review the rent and alter any other terms of the lease.
