Maternity Leave Dates Confirmation Letter
This Maternity Leave Dates Confirmation Letter enables an employer to acknowledge an employee’s chosen start date for her maternity leave. It also tells the employee when she is expected to return to work. The employer must send this letter within 28 days of receipt by the employer of the employee’s notification of maternity leave plans.
There is an optional paragraph in this letter for use in situations where the employee has chosen to take Additional Maternity Leave (AML). This paragraph reminds the employee that she may not be able to return to her original job after AML if it is not reasonably practicable for her to do so. The employee will, however, be entitled to return to her original job if she only takes Ordinary Maternity Leave.
This letter includes clauses covering the employee’s right to Statutory Maternity Pay (SMP). Details of SMP rates and how they are calculated can be found on the HMRC website. If an employee is not entitled to SMP, she should be given a form SMP1 (See Department of Work and Pensions website). The employee can then take this form to a Jobcentre Plus office to find out if she is eligible for Maternity Allowance.
If the employee intends to take the full 52 weeks of maternity leave to which she is entitled, she is not required to give any further notification to her employer that she will be returning to work. However, if she wishes to return to work before the end of her full maternity leave entitlement, she must give her employer eight weeks’ notice of the date she intends to return. Optional phrases
