Employee's Early Return to Work Notice
Eight weeks’ notice must be given by an employee if they intend to return to work early. This letter constitutes such notice and specifies the date on which the employee wishes to return.
The employee’s right to return to their original job depends upon the amount of leave taken. If the employee takes only 26 weeks’ Ordinary Maternity Leave (“OML”), she is entitled to her original job, pay, benefits and seniority. If the employee takes Additional Maternity Leave (“AML”) following OML, she is entitled to her original job or, where this is not practical, a job with conditions, pay, benefits and seniority at least as good as her old job.
