Suspension Policy
The Suspension Policy explains when suspension may be used, the process the company will follow, and the obligations that apply to an employee during a period of suspension.
It makes clear that suspension is a precautionary measure used to allow an investigation to take place. It is not disciplinary action and should not be treated as an assumption of guilt.
When this suspension policy is relevant
This policy is relevant where there is an allegation of misconduct that needs to be investigated and the employer is considering whether suspension is appropriate.
It should be read alongside the Disciplinary Policy and Disciplinary Procedure and the Guidance Notes: Disciplinary Procedure.
What the policy covers
The policy sets out:
- when a suspension may be given;
- the process the company will follow if suspension is imposed; and
- the obligations of the employee while the suspension remains in place.
Why suspension must be handled carefully
Suspension should be used carefully and only where justified by the circumstances. An unjustified period of suspension may amount to a breach of the implied term of trust and confidence.
In serious cases, that could lead to the employee resigning and claiming constructive dismissal.
