These Residential Lettings Agency Terms and Conditions are for letting agents providing a rent collection service for a landlord or property owner.
Use them with the Residential Lettings Agency Appointment Form (Rent Collection Service). Together, they form the agency’s contract with the landlord/owner.
What does the rent collection service cover?
Use this version where the agency handles the main letting stages and then collects rent during the tenancy, including:
- marketing, tenant enquiries, referencing and required checks;
- deposit handling, tenant documents, notices and prescribed information;
- rent collection, arrears handling and tenancy compliance support; and
- the agent’s authority, communications, Introduction Period and Rent Collection Period.
How are rent collection commission and extra services dealt with?
The terms provide for letting commission for tenant introduction and tenancy setup, plus rent collection commission payable in monthly instalments. Extra services, including safety checks, EPCs and inventories, should be set out in the Appointment Form and Agency Fees list.
Who is responsible for deposits, right to rent checks and landlord duties?
The terms cover holding deposit arrangements where applicable, tenancy deposit protection, Housing Act 2004 prescribed information and required documents, notices and prescribed information under applicable law, including the Renters' Rights Act.
- Landlord/owner responsibilities include consents, property information, ownership, safety and housing law, Tenant Fees Act 2019 compliance and forthcoming Renters' Rights Act 2025 requirements.
- Renters' Rights Act points include non-discrimination, pet requests, statutory rent increases and restrictions on re-letting after tenancy termination.
- Right to rent checks are included subject to the landlord/owner entering into a Right to Rent Responsibility Transfer Agreement.
Which residential lettings agency terms should I use?
Following the removal of fixed term tenancies under the Renters' Rights Act 2025, renewal commission wording has been replaced with a review option, allowing commission arrangements to reflect the agency’s business model and tenancy agreements.
