These Residential Lettings Agency Terms and Conditions are for letting agents providing a letting only residential agency service.

They cover tenant finding, referencing and tenancy setup, but not ongoing rent collection or full property management. Use them with the Residential Lettings Estate Agency Appointment Form Letting Only.

What does a letting only residential agency service cover?

Use this version where the agency sources a tenant and sets up the tenancy. The agency role may include:

  • rent advice, property particulars and marketing;
  • tenant enquiries, referencing, screening and required checks; and
  • tenant documents, notices and tenancy compliance support.

Who is responsible for tenancy deposit protection?

For this letting only service, tenancy deposit documentation is the landlord/owner’s responsibility. The owner must protect the security deposit under the Housing Act 2004 and give the tenant the prescribed information required by that Act within 30 days of the agent receiving the deposit.

How are letting only fees, extra services and compliance dealt with?

The terms provide for letting commission for tenant introduction and tenancy setup. Extra services, including safety checks, EPCs and inventories, should be set out in the Appointment Form and Agency Fees list.

  • Holding deposit arrangements are covered where applicable.
  • Required documents, notices and prescribed information are covered, excluding deposit documentation.
  • Right to rent checks are included only where the landlord/owner enters into a Right to Rent Responsibility Transfer Agreement.

Landlord/owner responsibilities include consents, property information, ownership, safety and housing law, Tenant Fees Act 2019 compliance and forthcoming Renters' Rights Act 2025 requirements. Renters' Rights Act points include non-discrimination, pet requests, statutory rent increases and restrictions on re-letting after tenancy termination.

Which residential lettings agency terms should I use?

Following the removal of fixed term tenancies, renewal commission wording has been replaced with a review option, allowing commission arrangements to reflect the agency’s business model and tenancy agreements.

Wider compliance wording covers cancellation rights, termination, complaints and redress scheme membership, Client Money Protection, data protection and GDPR, Anti-Money Laundering, consumer protection, VAT and financial provisions.

Use this version for letting only. Wider versions are available for rent collection, letting and deposit holding and fully managed arrangements.
