How The Agreement Works
This Appointment Form should be used alongside the Residential Lettings Ts and Cs (Fully Managed Service). Together, these documents form the legally binding contract between the Agent and the Owner/Landlord.
Fully managed Service Explained
This version is intended for a fully managed service, where the Agent is responsible for:
- Marketing the property and sourcing tenants
- Setting up the tenancy
- Managing the property on a day-to-day basis during the tenancy
There are alternative versions available for letting only, letting and deposit holding, and rent collection service appointments.
What Does The Form Include
The Form records all essential details required to set up the Agency relationship, including:
- Agent and Owner/Landlord details
- Property information and material information disclosure
- Start date and any fixed term
- Commission structure and fees
- Cancellation rights. At the end of the form is a “model cancellation form”. This is to comply with the 2013 Regulations referred to above which give a 14 day “cooling off” period in relation to contracts made off the trader’s premises.
- Rent and Security Deposit arrangements
- Provisions for the Owner/Landlord to confirm that they understand their obligations in relation to property or mortgage restrictions, material information disclosure, consumer protection requirements, and Renters’ Rights legislation.
Please note that under the Tenant Fees Act 2019, landlords and lettings agents in England can only charge specific “permitted payments” as outlined by the Act. These include rent, tenancy deposits, council tax, utilities, TV licences and default payments for late rent. If any unauthorised fees are charges, they could face financial penalties. Letting agents should download the Guidance Note: Tenant Fees Act 2019 (England). In Wales, similar rules apply under the Renting Homes (Fees etc.) (Wales) Act 2019 (RHFWA), which only applies to landlords and lettings agents in Wales. Any breach of this Act will result in a hefty fine.
Under the Renters' Rights Act, landlords and letting agents in England must clearly display the rent payable for the property and cannot encourage rental bidding. There are restrictions relating to rent in advance and increased protections for tenants against discrimination. The form includes confirmation from the Landlord/Owner concerning any previous letting period and confirmation that the property is not being let during any restricted period of time where a statutory notice was served, as well as confirmation of any enforcement action or banning order affecting the proposed letting.
