I am setting up a letting agency. What do I legally have to do before I take on clients? +
Before trading as a letting agent in England you must join one of the two government approved redress schemes, The Property Ombudsman or the Property Redress Scheme, protect any client money in an approved Client Money Protection scheme and display your fees, your redress scheme and your client money protection membership. What is the difference between the estate agent documents and the letting agent documents here? +
Estate agent documents are for sales: terms of business and appointment forms that set commission and the basis of appointment, whether sole selling rights, sole agency, joint sole or multiple agency. Letting agent documents are for arranging tenancies: letting only, rent collection or fully managed terms plus pre tenancy and compliance forms. Sales agents are governed mainly by the Estate Agents Act 1979, while letting agents face extra rules on client money, banned tenant fees and sanctions checks.
Do I need anti money laundering policies if I only do lettings, not sales? +
Only some lettings work is caught. You must register with HMRC and run full anti money laundering checks where a letting is for a month or more at rent equivalent to 10,000 euros a month or more. Below that you are outside HMRC lettings supervision, but since 14 May 2025 all letting agents are relevant firms that must make sanctions checks and report a suspected designated person to OFSI, whatever the rent. Can I just put my terms and conditions on my website, or do I have to give them to clients? +
You can publish them online, but a contract only forms when the client completes and signs the appointment form accepting your terms and you sign to confirm the appointment, so you must still provide the terms and get a signed form. For estate agency the Estate Agents Act 1979 requires your terms, fees and any personal interest to be given before the client is committed. Which documents do I need to handle a complaint from a client? +
You need a written complaints policy and a matching internal procedure. Membership of a government approved redress scheme is compulsory for estate and letting agents, and the schemes require you to run a written complaints procedure, so you cannot comply without one.
