This Welsh Government Model Written Statement of a Fixed Term Standard Occupation Contract is the model written statement prescribed by the Welsh Government which incorporates all the fundamental and supplementary provisions applicable to a fixed term standard occupation contract (without modification).

From 01 December 2022 (when the Renting Homes (Wales) Act 2016 (‘the Act’) came into force), private landlords in Wales grant new standard occupation contracts in place of tenancies and licences. Existing tenancies and licences caught by the Act converted to standard occupation contracts automatically on 01 December 2022.

This model written statement can be used by private landlords and letting agents in Wales as the basis for creating a new fixed term standard occupation contract. A landlord and contract-holder may wish to modify and omit certain terms, but this must be done in accordance with the Act. Additional terms can also be added but these must not conflict with the fundamental and supplementary terms of the contract.

The model written statement of contract does not have to be used but the contract used must comply with the provisions of the Act.

Standard occupation contracts are the contracts which will most commonly be used by private landlords. There are two types of standard occupation contract; 1) periodic; and 2) fixed term.

A fixed term occupation contract means it initially lasts for a specified period of time agreed between the landlord and contract-holder. If the contract-holder remains in occupation of the dwelling after the end of the fixed term, the parties are to be treated as having made a new periodic standard occupation contract in relation to the dwelling.
