This Application Form for a Residential Standard Occupation Contract is for use by a residential landlord or letting agent in Wales to gain information about the proposed contract-holder (and any proposed guarantor) to consider their suitability and to obtain references.
The proposed contract-holder must provide name and address information, as well as details of their employer, bank and previous landlord. They may provide an email address and may (optionally) confirm that this email address can be used to serve notices and other documents on them.
The proposed contract-holder needs to tick boxes and sign the form to authorise the landlord or letting agent to carry out credit checks and to obtain references. The proposed contract-holder also acknowledges receipt of the Privacy Notice for Contract-Holders, Residents and Guarantors. This should be supplied with this Application form. If there are concerns about the contract-holder’s financial position, the proposed contract-holder may need to provide one or more guarantors.
Under the Renting Homes (Fees etc.) (Wales) Act 2019, landlords and/or letting agents are prohibited from charging tenants fees for setting up new occupation contracts caught by these requirements, which includes the cost of obtaining references. It will be the landlord’s responsibility to meet these costs.
