These E-Commerce Sale of Services Website Terms of Sale are designed for use by traders on e-commerce websites selling services to consumers. These terms are sufficiently broad to cover many different kinds of services. This document governs transactions through your website and is designed for use with a counterpart set of terms of use, available here.

Using consumer-friendly language, these e-commerce terms of sale guide customers through the order process, explaining the formation of the contract between them and the retailer, also setting out details on services, pricing and availability (with particular regard for the accuracy of, and changes to such information), payment, and the provision of the services themselves.

When dealing with the provision of the services, obligations are imposed on both the service provider and the customer (the latter, for example, may be required to take certain actions or provide certain information and the service provider will not be held responsible for the customer’s failure to do so). It is important to note that the services themselves are not specified in these terms and conditions and that detailed information about them should be provided elsewhere including in the order confirmation sent to the customer as part of the order process.

Of particular importance is the customer’s right to cancel. In some cases the customer may wish to cancel under the 14-day cooling off period granted to them under the 2013 Consumer Contracts Regulations. In other cases, the customer may wish to cancel after the expiry of the cooling off period. Detailed clauses deal with both avenues of cancellation providing guidance to customers on their rights and the appropriate steps to take. Also important are the service provider’s rights to cancel the contract, not least in situations where they are unable to continue providing the services or where the customer is in default.

Further key provisions deal with problems with the services, liability, events beyond the service provider’s control, customer complaints (with reference to complaints handling policies and procedures, templates for which are also available from Simply-Docs), contact information, and data protection.
