These Terms of Use for E-Commerce Sale of Adult Content Websites are designed for use by online retailers on e-commerce sites providing adult content to consumers.
This document is designed for use with a counterpart set of terms of sale, available here. This template applies to the use of your site itself, leaving the terms governing the sale of paid content to a separate document.
Please Note: This document, together with the counterpart terms of sale, replaces the previous TR.WEB.TC.10a and TR.WEB.TC.11a documents. Whereas the previous versions were designed for use as single templates, the new versions must be used together.
These Website Terms are designed for acceptance through use. When a user visits your website, they are deemed to have accepted them. Optional wording in this template also allows for the terms to be accepted as part of the sign-up process on your website.
Important information about the website operator is set out in these website terms, including company registration details, trading address, and details of any relevant regulatory bodies or associations (VOD providers, for example, should be aware of Ofcom’s regulatory role). For some trades and professions, additional information may be required. Members of regulated professions should include professional titles, links to professional rules and other important details. Such details are not included in this template and professional advice should be sought by those working in regulated professions.
Being designed for sites offering adult content, these website terms include important notices regarding the age of individuals appearing in that content. Please note: Legal compliance statements have been included in this template as common examples only. It is your responsibility to seek professional guidance on any and all relevant requirements that may apply to your website and other key aspects including, but not limited to, its particular content, target audience, and availability in different jurisdictions.
Intellectual property rights including, but not limited to, copyright are protected by these terms of use. Optional provisions are included in the document to allow you to choose how many freedoms to give to your users with regard to saving and copying material from your site, as well as establishing deep-links to pages within your site on other sites. Further provisions concerning linking are also designed to help to prohibit users from establishing links to your website from websites publishing unsavoury or unlawful content.
Disclaimers and liability provisions in this document seek to protect website operators to the maximum extent deemed reasonable. It is important, however, to ensure that such provisions are not unduly biased against users – particularly when dealing with consumers – lest they be considered unfair in the eyes of the law. Additional liability provisions, therefore, are provided that apply only to business users.
