Door Supervision Service Agreement (Sub-Contractors Own Insurance)
BS.SEC.01B
This Door Supervision Service Agreement is designed for use by individuals
and business providing door supervision services to (typically) licenced
establishments.
This document provides a framework covering all of the essential legal
matters required for a contract of this kind. The exact nature of the
services to be provided should be detailed in full in the schedule at the
end of the document.
A central provision in this template includes a detailed set of formalities
governing the provision of the services. These formalities include the
all-important requirement that door supervisors be licenced by the Security
Industry Authority (“SIA”). Further key provisions govern matters such as
insurance, liability, payment and confidentiality.
This agreement can be used both by security service providers that employ
their door supervisors and those that use sub-contractors. It is important
to note that, under the terms of this document, the main contractor is
responsible for any actions or breaches of the sub-contractor as if they
were undertaken or committed by the main contractor itself.
The default position for insurance under this template is that it should
not cover sub-contractors, thus requiring sub-contractors to take out their
own insurance. An alternative version is available which provides for the
service provider’s own insurance policy to cover sub-contractors. Insurance
taken out by sub-contractors should provide the same level of cover as the
insurance taken out by the main contractor. Great care should be taken when
selecting the appropriate agreement and you should always ensure that you
fully understand the terms and conditions of your insurance.
For service providers using sub-contractors, a Security Sub-Contractor
Agreement is also available for use when “hiring” the sub-contractors.
A set of counterpart terms and conditions (standard terms of business) is
also available.
Optional phrases / clauses are enclosed in square brackets. These should be
read carefully and selected so as to be compatible with one another. Unused
options should be removed from the document.
