Manned Guarding Security Service Agreement (Sub-Contractors Own Insurance)
This Manned Guarding Security Service Agreement (Sub-Contractors Own Insurance) is designed for individuals and businesses providing manned security services to a range of clients.
It is suitable for arrangements involving security guarding services such as building security and site security, with the exact services to be set out in the Service Level Schedule.
Manned guarding agreement for building security and site security services
This template provides a contractual framework for the main legal and commercial issues involved in a manned guarding arrangement.
It can be used by providers who employ security guards directly and by those who use sub-contractors.
SIA licensing and client policy compliance
A central part of the agreement is the formal framework governing how the services are delivered, including the requirement for security guards to be licensed by the Security Industry Authority.
The agreement also allows for security guards to comply with relevant client company policies. Care should be taken not to include policies that should apply only to the client’s own employees, such as holiday, sickness and absence, disciplinary procedures, and similar internal employment policies.
What this manned guarding contract covers
- the formalities governing the provision of the guarding services;
- client obligations;
- insurance and liability;
- payment and records;
- confidentiality; and
- termination and its effects.
Sub-contracting and insurance for security guards
Where sub-contractors are used, the main contractor remains responsible for their acts and breaches as if they were its own.
- In this version, the default position is that the main contractor’s insurance does not cover sub-contractors.
- Sub-contractors are therefore expected to maintain their own insurance.
- That insurance should provide the same level of cover as the main contractor’s insurance.
A separate version is available where the service provider’s own insurance covers sub-contractors instead. Care should be taken to choose the correct agreement and to ensure that the insurance arrangements match the intended structure.
