Third Party Rights Clause
This Third Party Rights Clause establishes whether or not a contract is intended to confer rights on any third parties and, consequently, whether or not the Contracts (Rights of Third Parties) Act 1999 applies.
Two options are included in this template. The first is for contracts which are not intended to benefit third parties. The second choice sets out the details of the specific third parties that the contract is intended to benefit.
This template clause has been reviewed and updated. It now includes optional sub-clauses as detailed above.
This template clause can be used in the drafting of a new contract or to amend or improve an existing one.
