Driving School Terms & Conditions

These Driving School Terms of Business are designed for use by driving schools that engage instructors on a self-employed basis.

They cover the relationship with pupils from the booking of lessons through to the driving test, on the basis that instructors provide tuition as subcontractors on behalf of the driving school rather than in their own name.

This template is not intended for individual instructors operating independently of a driving school. For that situation, the separate Driving Instructor Terms of Business should be used.

When to Use These Driving School Terms

This template is intended for use where the driving school contracts with the pupil as the service provider.

It assumes that lessons are generally booked and paid for in advance, often in blocks. References to a pupil being charged for a lesson are therefore intended to reflect deductions from prepaid lessons where applicable.

Consumer Contracts and Cancellation Rights

These terms should be used only where the pupil is a consumer within the meaning of the Consumer Rights Act 2015.

They are suitable for on-premises, off-premises, and distance contracts under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The Regulations require certain information to be given before the pupil books a first lesson and, for off-premises and distance contracts, also give the pupil cancellation rights reflected in the terms.

This document has been updated to take full account of the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Flexible Options for Driving School Operations

The template includes optional provisions to reflect different ways in which a driving school may operate.

  • Lesson fees can be paid directly to the school or collected by instructors and then paid over to the school
  • Lessons can, where required, be taken in the pupil’s own car
  • Responsibility for booking driving tests can be allocated to the appropriate party
