The Notice of Final Disciplinary Poor Performance Hearing should be sent on the continued poor performance of the employee and the rejection of an alternative offer of employment.

This notice refers to the previous warning and confirms the employee's entitlement to be accompanied by a colleague or trade union representative.

When to use this final poor performance hearing notice

This letter is used where the employee’s poor performance has continued after earlier formal action and the employer is moving to a final disciplinary poor performance hearing.

It should be used alongside the Performance Management Review Procedure.

Previous warning and right to be accompanied

The notice should refer to the previous warning issued to the employee and confirm their entitlement to be accompanied at the hearing by a colleague or trade union representative.
