The Poor Performance And Capability Final Formal Warning is issued following the final disciplinary hearing and states that the employee's employment is at risk due to a poor performance record.

It also confirms that the warning will be placed on the employee's personnel file.

When to issue this final formal warning

This letter follows the Notice of Final Disciplinary Poor Performance Hearing where the employer decides that a final warning is appropriate.

It should be used alongside the Performance Management Review Procedure.

Improvement targets and monitoring

The warning is to be disregarded for disciplinary purposes should the employee's conduct improve within a given period.

The employee's current position is defined and target(s) set for improvement. The employee's performance should continue to be monitored.

If poor performance continues

Following a further reasonable time and fair evaluation of the performance, should the employee's performance continue to be poor, the employer should have duly carried out sufficient steps and considerations to decide whether or not to dismiss the employee.

If the outcome is dismissal, the employer may need to use the Poor Performance And Capability Notice Of Dismissal.

Appeal rights

The employee should be informed of the right to appeal and the number of days within which the appeal must be made.
