Employment Agency & Employment Business Terms and Conditions
Recruitment agencies and businesses often work with lots of clients and candidates or temporary workers at the same time. Having clear terms and conditions in place helps everyone understand the “rules of engagement” from the outset: what you will do, what your client or worker must do, and how fees, liability, confidentiality and data protection are handled.
Employment Agency vs. Employment Business – What’s the Difference?
These terms describe two different ways of operating and are not interchangeable. Your choice of terms and conditions will depend on which model you use (and many recruiters will do a bit of both).
Employment Agency
An employment agency introduces candidates to a client. The agency is paid for the introduction, and the candidate is then hired directly by the client. In other words, the agency is not supplying labour, it is introducing people for the client to engage as its own employee (or contractor).
Employment Business
An employment business supplies individuals to work for a client on a temporary basis. The worker is engaged by the employment business (typically as an employee or a worker or contractor) and is assigned to the client to work under the client’s day-to-day supervision. The client pays the employment business, and the employment business pays the worker.
