I run a commercial lettings and management agency. What service versions do these terms cover? +
Three: letting and management, where you both market the property and run its day to day management, letting only, where your role ends once a tenant is in place, and management only, where you manage a property let by someone else. Do the tenant fee ban and client money rules apply to commercial lettings? +
The Tenant Fees Act 2019 applies to assured shorthold and other residential tenancies, not commercial lettings, so those fee bans do not bite on business tenancies. Mandatory Client Money Protection membership applies to residential lettings work, not purely commercial work, though holding client money still calls for proper protection and accounting. Check whether any part of your work is residential.
Does a commercial letting agent have to do anti money laundering checks? +
Yes where the letting is high value: registration with HMRC and full checks are required where a commercial letting is for a month or more at rent equivalent to 10,000 euros a month or more. Separately, since 14 May 2025 all letting agents must run sanctions checks and report a suspected designated person to OFSI, whatever the rent. How does the appointment actually become a binding contract? +
The owner completes and signs the appointment form accepting the relevant terms and conditions, and you sign to confirm the appointment. Publishing the terms on your website is not enough on its own: they must be provided to the owner and accepted. Using the matching appointment form for the chosen service level keeps the contract clear.
