I want to let a field or open piece of land. Do I need a lease or a licence? +
It turns on how much control the occupier gets. A lease gives exclusive possession for a fixed term; a licence gives only permission to use the land, usually short or shared. If you grant exclusive possession for a term the law treats it as a lease whatever you call it. This folder holds leases, licences and tenancies at will for farms, car parks, playing fields, allotments and advertising sites.
Will my business tenant have a legal right to stay when the term ends? +
Usually yes. A lease of land to a business occupier is protected by Part II of the Landlord and Tenant Act 1954, which gives a right to renew unless you contract that right out before the lease starts. Licences and tenancies at will do not carry this protection. Decide at the outset which arrangement you want, because you cannot remove the right once the protected lease is granted.
I am letting bare farmland. Is that automatically a farm business tenancy? +
It is if the letting meets the conditions in the Agricultural Tenancies Act 1995: the land is farmed for a trade or business and the arrangement is a tenancy granted on or after 1 September 1995. Most modern agricultural lettings of bare land are farm business tenancies. A genuine licence with no exclusive possession, or a short seasonal grazing arrangement, may sit outside the Act.
What is a tenancy at will and when would I use one? +
A tenancy at will has no fixed term and either party can end it at any time with immediate effect. It suits a very short bridge, for example letting someone occupy while you finalise a lease. Because it can be ended at once it gives no security of tenure. Keep it genuinely at will: regular rent over a long period can turn it into a protected periodic tenancy.
