What is an option agreement and why would a developer use one?
An option agreement gives a buyer the right to purchase land during a defined option period, without either side being bound to complete straight away. A developer uses one to tie up a site while they test viability or pursue planning permission, then exercises the option once the position is clear. The landowner is paid for granting the option and is committed to sell if it is exercised.
We are buying a property together in unequal shares. How do we protect that?
Record it in a declaration of trust. The deed sets out each owner's share and how the property is run, and it is the document a court will look to if you later disagree or sell.
