I am renting out my property to holidaymakers. Do I need a tenancy agreement? +
Not an assured tenancy. Holiday occupation is excluded from assured tenancy status by Schedule 1 to the Housing Act 1988, so you use a holiday letting agreement or an online booking contract, not a residential tenancy. This keeps the guest from gaining security of tenure and lets you get the property back on the agreed date. What is the difference between a signed holiday agreement and online booking documents? +
A holiday letting agreement is printed and signed by both parties, suited to direct bookings. Online booking documents work differently: the guest submits a booking form and you send a confirmation letter, which forms the contract and brings in your terms and conditions, without anyone signing a single document. Choose the signed agreement or the booking suite to match how you take bookings.
Do holiday guests have a 14 day right to cancel and get a refund? +
Usually no. The Consumer Contracts Regulations 2013 give a 14 day cancellation right for many online purchases, but accommodation supplied for a specific date is exempt, so a dated holiday booking is not automatically cancellable. What the guest can cancel depends on your terms, so a clear cancellation and deposit policy matters. The booking terms templates set this out.
Has the tax on holiday lets changed? +
Yes. The Furnished Holiday Lettings tax regime was abolished from 6 April 2025, so from the 2025 to 2026 tax year holiday let income is taxed under the normal rules for residential rental income, without the old reliefs. A separate short term lets registration scheme for England is being introduced but is not yet in force. Confirm your current position with GOV.UK or an accountant.
What safety rules apply when I let my property as a holiday home? +
The core duties are an annual gas safety check by a Gas Safe registered engineer, a fire risk assessment with working smoke and carbon monoxide alarms and safe electrics, and you should carry suitable holiday let insurance.
