Holiday Property Lettings Agency Terms and Conditions

The documents in this subfolder are for use by Holiday Property Lettings Agencies. Many owners of holiday homes do not have the time or specialist knowledge required to manage bookings themselves. Instead they will appoint an agency to market the property, handle bookings and in some cases manage the property on their behalf. 

This Holiday Property Lettings Agencies subfolder contains Terms and Conditions and Appointment Forms which, when used together, create a contract between the Owner and the Agent. There are versions for a “Fully Managed” service, where the Agent deals with repair and maintenance of the property as well as marketing and bookings, and “Marketing and Letting Only” versions.

The Terms and Conditions and Appointment Forms can be placed on the Agent’s website or made available in hard copy. An agency contract is formed by the Owner completing and signing the appropriate Appointment Form, confirming acceptance of the relevant set of Terms and Conditions.

I want to manage holiday homes for owners. What agreement do I need with the owner? +
A holiday property lettings agency agreement: terms and conditions plus an appointment form that together form the contract between owner and agent. Choose a fully managed version, where you handle repairs and maintenance as well as marketing and bookings, or a marketing and letting only version. Matching the terms to your actual service avoids disputes. This folder provides both versions.
Are holiday lets treated as tenancies, so do the usual landlord rules apply? +
No. A letting for a holiday is excluded from assured tenancy status by Schedule 1 to the Housing Act 1988, so security of tenure, section 8 grounds and the Renters' Rights Act reforms do not apply. Holiday occupation is a contractual licence or short booking, governed by the booking contract and consumer law. That is why these agency terms are built around bookings, not tenancy law.
Do I need to do money laundering checks on holiday lettings? +
HMRC anti money laundering registration for lettings only bites at 10,000 euros a month or more, which few holiday lets reach, so most holiday agency work is outside it. Since 14 May 2025, though, all letting agents are relevant firms who must run sanctions checks and report a suspected designated person to OFSI, whatever the value. Estate agency sales work is always in scope.
Who is responsible for gas and fire safety in the holiday homes I manage? +
The owner holds the core legal duties, but a managing agent often takes on arranging compliance, so agree clearly who does what. Holiday accommodation needs an annual gas safety check by a Gas Safe registered engineer, a fire risk assessment and safe electrics. Spelling out responsibility in the agency terms protects both sides. The fully managed version can allocate these tasks to the agent.
