This Letter to tenant requesting access to carry out energy improvement works is for use by a commercial landlord whose tenanted property requires works to upgrade the energy efficiency to meet the Minimum Energy Efficiency Standards Regulations. This letter should be printed on the landlord’s headed paper and sent to the tenant.

Most tenancy agreements allow the landlord or their agent to enter the property for the purposes of inspecting the property generally but not all specifically provide the Landlord rights to access for the purpose of carrying out energy efficiency works. Our Simply-docs templates do provide this. The tenant can reject the request where the lease does not provide access rights for this reason, but the landlord should take steps to negotiate access and highlight the potential energy saving benefits to the tenant.  Where all reasonable attempts have been made to access the property for works and the lease does not expressly provide the landlord with rights to enter and carry out the energy efficiency works, advice should be taken about whether an exemption can be registered.  This exemption will not be available where there are express rights of access within the lease.

Landlords and agents should ensure that they comply with the relevant terms of the tenancy agreement when arranging viewings, not least by providing sufficient notice.

This Letter provides the tenant with details of the work and the contractor. It also provides optional clauses as to who is responsible for the costs of any works. The tenant is asked to sign a copy of the letter and return it to the landlord to confirm their acceptance of the arrangements. 

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
