This Deed of Surrender of Commercial Lease can be used to enable the landlord and tenant of business premises to end the lease before the end of the contractual term.

The Deed confirms that the tenant will surrender the lease to the landlord and that both parties’ obligations under the lease will come to an end. If the landlord has agreed to pay a premium for the surrender there is optional wording to provide for this.

Sometimes the landlord will require the surrendering tenant to make a payment in respect of disrepair to the property (reflecting a breach of the tenant’s repairing covenant). This Deed of Surrender does not cater for this scenario.
