Airbnb Agency Agreements

The documents in this subfolder are for use by Agencies specialising in the management of Owners’ Airbnb-type rentals. Many Owners of short-term holiday accommodation do not have the time or specialist knowledge required to handle bookings and management themselves. Instead they will appoint an Agency to carry out some or all of the work. 

This subfolder contains Terms and Conditions and Appointment Forms which, when used together, create a contract between the Owner and the Agent. There are alternative versions for a “full” service, where the Agent deals with marketing and bookings, as well as management during guest stays, and “management only”, where the Agent’s role is more limited.

An Airbnb agency agreement between you and the owner: terms and conditions and an appointment form that together form the contract. Choose a full service version, covering marketing, bookings and management during guest stays, or a management only version where your role is narrower. Does managing short term Airbnb style lets bring any legal duties I should know about? +
Yes. Short term lets are excluded from assured tenancy law, but you still deal with consumer booking law, safety duties on the properties and, since 14 May 2025, sanctions checks that apply to all letting agents whatever the value. England is also introducing a short term lets registration scheme, not yet in force. Build these into how you run the properties.
Whose job is guest safety, mine or the owner's? +
The owner holds the core safety duties as the person providing the accommodation, but a managing agent usually arranges the checks, so agree who does what in writing. Each property needs an annual gas safety check, working smoke and carbon monoxide alarms, a fire risk assessment and safe electrics. The full service agreement can allocate these tasks to the agent.
Do I need planning permission concerns on my radar for short term lets? +
Sometimes. Whether short term letting needs planning permission depends on the property and its use, and your local planning authority decides, so owners should check with the council. A registration scheme for short term lets in England is also being introduced. Flagging these to owners is good agency practice. Note them in your terms and onboarding.
