Part-time Employment Contract

The Part-time Employment Contract is designed for employees who work agreed hours on fixed days each week.

Employers must provide workers and employees with a written statement of their main terms and conditions of employment (often known as a Standard Form Section One Statement).

This Employment Contract covers the requirements of a Standard Form Section One Statement and must be provided to the employee or worker by day one of employment.

When to use this contract

Many employers have roles that do not require an employee to work full-time hours, or want to retain skilled workers who wish (or need) to reduce their working hours. Equally, employees may prefer fewer hours because of family responsibilities or to pursue other interests.

Use this contract where the employee’s hours and working days are agreed and fixed. If the individual is engaged on a more flexible basis, use the Zero Hours or Casual Worker contracts instead.

Pay, benefits and working time

This contract takes into account the requirement to provide part-time workers with the same rates of pay and benefits as full-time workers on a pro rata basis.

The Working Time Regulations 1998 provide that a worker whose working day is six hours or longer must be granted a rest break of at least 20 minutes during the working day. This contract offers alternative clauses depending on whether or not the employee is entitled to a rest break.

Duties and job description options

The “Duties” clause allows you to set out the duties and responsibilities of the role. Alternatively, you can state that duties are “as determined by the Company from time to time”, or refer to a separate job description.

  • Place of work, work outside the UK, and hours of work (including rest breaks where applicable)
  • Pay and benefits, holidays, other paid leave, training and sickness absence
  • Pension, maternity and paternity rights, and non-compulsory retirement
  • Restrictions and confidentiality, collective agreements, grievance and disciplinary procedure
  • Data protection, changes to terms, severability, governing law and right to work in the UK
