Homeworker Agreement

This Homeworker Agreement is designed for situations where a new or existing employee agrees that their main place of work will be somewhere other than the employer’s office, or otherwise in a location which is not under the control of the employer.

Use this agreement to confirm homeworking terms from day one

Employers must provide workers and employees with a written statement of their main terms and conditions of employment and this is often known as a Standard Form Section One Statement.

This agreement covers the requirements of a Standard Form Section One Statement and must be provided to the employee or worker by day one of employment.

Why a dedicated homeworking agreement can help

Employers may find that employing staff as homeworkers reduces overheads, while employees are given greater freedom and the opportunity to work in more comfortable surroundings.

This agreement is drafted to help employers meet their legal obligations to employees, while setting expectations to ensure the work received remains of the standard that might be expected in a more controlled environment.

Homeworking-specific clauses included

The agreement includes a ‘Right to Enter’ clause entitling the employer to enter the employee’s premises at reasonable times to inspect company property, carry out risk assessments, and recover company property following termination of employment.

It also includes provisions dealing with equipment the company will provide (including installation, servicing and insurance), and an expenses option providing for reimbursement of pre-approved expenses or, alternatively, a fixed monthly allowance to cover expenses.
