Personal Assistant Employment Contract (Company)
This Personal Assistant Employment Contract (Company Version) is for use when a company employs a person to work as a PA.
Employers must provide workers and employees with a written statement of their main terms and conditions of employment and this is often known as a Standard Form Section One Statement.
As this is potentially a close relationship, this contract has special provisions incorporated to make sure that any disagreements can be dealt with in a straightforward manner (e.g. it is made clear that the employee will need to work flexible hours, and that any additional hours will not attract overtime payment). The contract also specifies the sums can be deducted from the personal assistant’s salary, to avoid misunderstandings, and contains an optional clause covering the provision of health insurance and other benefits. Additionally, it contains an enhanced confidentiality clause to reflect the fact that the employee may have access to sensitive personal information.
This Personal Assistant Employment Contract (Company Version) complies with all relevant employment law and sets out the employee’s rights and company obligations, therefore minimising the risk that an employer will be found to have breached any of those rights or obligations. It also provides many additional clauses that provide greater protection to the employer, and which address the personal nature of the relationship between an employer and a personal assistant.
The Pensions Act 2014 introduced a new state pension for people reaching state pension age on or after 6 April 2016, replacing the previous basic state pension and additional state pension and ending contracting out for defined-benefit schemes. This employment contract has been updated accordingly with the removal of the clause referring to the contracting out certificate.
