Shift Work Employment Contract
This Shift Work Employment Contract is designed for use by businesses which, by nature of their industry or the need to remain competitive, employ people to work shifts and keep their business operating 24 hours a day 7 days a week.
Employers must provide workers and employees with a written statement of their main terms and conditions of employment and this is often known as a Standard Form Section One Statement.
This Employment Contract covers the requirements of a Standard Form Section One Statement. This contract complies with these requirements and must be provided to the employee or worker by day one of employment.
This contract allows for flexibility and alteration of shift work patterns, and space has been left for the specific details of the shift work patterns to be inserted according to business’ specific needs.
The employment contract complies with all of the necessary employment law and details employee’s rights and company obligations, therefore minimising the risk that an employer will be found to have breached any of those rights or obligations.
This contract entitles the employer to ask employees to work overtime at short notice, but clarifies the duty of employers to arrange free medical checks for employees who work night shifts. There are also “shift swap” clauses which explain how employees can swap shifts and set out the mechanics of swapping shifts.
