This Commercial Property Lettings Agency Appointment Form (Management Only Service) can be used by a commercial property lettings or management agency when a Landlord client wants the Agency to take over the management of a property that is already let. The form is completed and signed by the Owner and the Agent.
The Appointment Form, when used with the Commercial Lettings Agency Terms and Conditions (Management Only Service), creates a contract between the Agency and the Owner. The Appointment Form and Terms and Conditions can be displayed on the Agency’s website but should also be provided to the Owner in hard copy.
This version of the Appointment Form should be used where the Agency is taking over the management of a property that is tenanted. If the Agency is to become involved at an earlier stage, and will be marketing the property for rental, the “Letting & Management” version of the Appointment Form should be used instead.
The Appointment Form contains fields for the Agent’s details, the Owner’s details, a description of the property and details of the lease (or licence to occupy) and the tenant. Details of the agency arrangements are also captured: the agency start date, fixed term and Commission. Under the RICS Professional Statement 'Service charges in commercial property (1st edition)' RICS members or firms regulated by RICS, must charge management fees (for administering the services comprised in the service charge) on a fixed price basis.
By signing the form the Owner confirms that there are no restrictions (such as planning control, mortgage conditions or restrictions in the title deeds) that prevent the property being let. Owners should investigate these matters before entering into a contract with an Agency.
