Medical advice should be obtained before dismissal.
If that medical evidence indicates that the employee is disabled within the meaning of the Equality Act 2010, dismissal may be discriminatory and the employer will be under a duty to make reasonable adjustments.
Notice Pay During Sickness Absence
An employee who is under notice of termination is entitled to be paid their normal rate of pay during the notice period if they are incapable of work because of sickness or injury.
This applies whether or not the employee was receiving statutory sick pay or contractual sick pay before notice was given.
Appeal Against Dismissal
The employee should be informed of the right to appeal and the number of days within which any appeal must be made.
