Jury Service Letter

Jury Service Letter is used to respond to an employee who has been called for jury service.

The employee should tell the employer how long they expect to be absent and provide a copy of the jury service confirmation letter.

Pay during jury service

There is no statutory duty on an employer to pay an employee who is absent on jury service.

This template covers all three common approaches:

  • paying normal pay;
  • topping up court allowances to full pay; or
  • making no payment.

Loss of earnings claims and contract terms

An employee who is not paid in full during jury service can complete a Certificate of Loss of Earnings or Benefit to claim a loss of earnings allowance from the court.

Employers should also note that, if they decide not to pay employees during jury service, employees’ contracts should contain a clause making that clear.

Court allowances are capped, so a decision not to pay full salary may cause financial hardship for the employee.
