These Gym Terms of Business are designed for use by gyms, health clubs, leisure centres and similar establishments that provide exercise and fitness equipment, facilities, classes and instruction. Key aspects of such businesses are covered including membership terms and rules of the establishment.

Designed to be as flexible as possible, this set of terms of business contains a large number of optional clauses and/or phrases. Clause 2, for example, contains a number of options allowing for different membership structures, suspension and transfer.

Further optional sections (clauses 6 to 9) are included which address additional facilities that your establishment may or may not provide including car parking, classes, swimming pool and tanning facilities. You may, of course, wish to add further clauses if you provide additional facilities for which you wish to specify terms and conditions.

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so that they are compatible with one another. Unused options should be removed from the document.

These terms should be used only where the membership of the gym or other establishment is to be taken by a customer who is a “consumer” as defined in the Consumer Rights Act 2015 (i.e. an individual who receives services or uses facilities for his/her personal use and for purposes wholly or mainly outside the purposes of any business of that individual or another). The terms are suitable for use where the contract is an “on premises”, “off premises” or “distance” contract as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The Regulations require you to supply certain information to customers who are consumers before they join the gym. Where the contract is an “off premises” or “distance” contract, the Regulations also confer on the customer certain rights to cancel their membership and we have set these out in the terms themselves.
