Hotel Terms of Business (B2B)
These Hotel Terms of Business are designed for use where a hotel supplies accommodation and related services to business customers, that is, where the services are wholly or mainly for the purposes of the customer’s business or another business.
They are not suitable for consumer bookings. Where the customer is a consumer, the appropriate alternative is Hotel Terms of Business (B2C).
This document has been updated for Brexit. References to data protection legislation have been updated with reference to the UK GDPR.
When to Use These B2B Hotel Terms
This template is intended for hotels taking bookings from businesses and other organisations rather than private consumers.
It is suitable both for group bookings, such as bookings for employees or other individuals attending meetings, events, or overnight stays, and for bookings covering only one or two individuals.
Built for Business Bookings and Hotel Facilities
The terms cover the main practical and legal issues that arise in business hotel bookings, including reservations, changes to bookings, fees and payment, cancellations, check-in and check-out, hotel rules, complaints, dispute resolution, and liability for theft, loss, or damage to customer property.
They also allow the customer to identify authorised individuals who can make bookings or request services on its behalf, helping to reduce disputes over authority and responsibility for charges.
Flexible Options for Hotel Services
This template is designed to accommodate a range of hotel services and facilities.
- Bedroom accommodation and related booking arrangements
- Meeting, conference, and reception rooms
- Food and drink
- Car parking
- Fitness and leisure facilities
- Facilities provided in bedrooms and event spaces, with scope for additional charges where applicable
It also assumes that the hotel may offer promotional rates, such as discounted rates for early booking and advance payment, and includes payment provisions to reflect that pricing model.
Making Sure the Terms Apply
It is important that the contract with the customer properly incorporates these terms and conditions.
The customer should be given a copy of the terms before making a booking offer, with clear notice that the booking will be on those terms. One way to do this is by using a booking form that contains or attaches the terms, states that they apply, is signed by the customer, and is then accepted or confirmed by the hotel as the booking.
Data Protection and Other Key Protections
The template includes provisions dealing with data protection and optional data processing, alongside other key contractual protections such as set-off, assignment and subcontracting, third party rights, notices, entire agreement, dispute resolution, and governing law and jurisdiction.
