I am letting bare farmland. What kind of tenancy am I creating? +

Almost certainly a farm business tenancy under the Agricultural Tenancies Act 1995. That regime applies to agricultural tenancies granted on or after 1 September 1995 where the land is farmed for a trade or business. These templates give you short-term and longer-term farm business tenancy agreements with covenants controlling what the tenant can do on the holding.

How much notice do I need to end a farm business tenancy? +

For a farm business tenancy of more than two years, at least twelve months' written notice ending on the term date. Such a tenancy does not simply stop on the end date; it continues from year to year unless either party gives at least twelve months' written notice before the term date. The twelve-month written notice rule also applies to yearly farm business tenancies.

Is my tenancy governed by the 1995 Act or the older 1986 Act? +

It depends on when it was granted. Agricultural tenancies granted on or after 1 September 1995 are usually farm business tenancies under the 1995 Act. Tenancies that began earlier can still fall under the Agricultural Holdings Act 1986, which gives lifetime security of tenure and limited succession rights. That difference matters, so identify the regime before you serve any notice.
