Misconduct Notice Of Dismissal
The Notice of Dismissal in respect of Misconduct is used where an employee’s misconduct has continued and the outcome of the final disciplinary hearing is dismissal.
It records the date of the final hearing, refers to the written formal warning already issued, and confirms the employer’s decision to terminate the employee’s contract of employment because the misconduct has continued.

This letter should be used at the end of the disciplinary process where earlier warnings have not led to the required improvement and dismissal is the final outcome.

What the letter needs to confirm
The notice should clearly set out:

- the written formal warning that had previously been issued; and
- the decision to dismiss because the misconduct has continued.
Appeal rights and disciplinary procedure
The employee should be told that they have the right to appeal. The letter should also state the number of days within which any appeal must be made.
