Term-time Working Policy

Term-time working is a form of flexible working under which an employee remains on a permanent employment contract but has the right to take unpaid leave during the school holidays.
This Term-time Working Policy references the Flexible Work Policy in relation to the process for applying for a flexible working arrangement.
Who this term-time working policy is for
This policy is intended for employers offering term-time working arrangements. It explains how those arrangements operate and the main terms that apply where an employee works only during school term times.
Employers should note that term-time workers are protected under the Part-Time Workers (Prevention of Less Favourable Treatment) Regulations. Employees working on a term-time basis are therefore entitled to the same terms and conditions as full-time employees on a pro rata basis.
Rolled-up holiday pay and annual leave
Employers should also be aware that, for leave years starting on or after 1 April 2024, they may use rolled-up holiday pay for term-time workers.
Rolled-up holiday pay means paying an additional amount on top of the employee’s normal hourly rate to represent holiday pay, rather than the employee receiving that payment when taking leave.
What the policy deals with
The policy covers eligibility, the procedure for agreeing a term-time working arrangement, salary arrangements, annual leave, work during school holiday periods, and bringing the arrangement to an end.
