Ineligibility to Request Flexible Working Letter

This Ineligibility to Request Flexible Working Letter is designed to follow on from the receipt of a written application for flexible working hours or from a flexible working application form. The employer should use this letter to inform an employee that he or she is ineligible to submit such a request.

The right to request flexible working is available to employees with at least 26 weeks’ continuous service. An employee is ineligible to request flexible working if he or she does not have 26 weeks’ service or has made a flexible working request in the last 12 months.

Employers must handle applications for flexible working in a “reasonable manner”.
