Many commercial contracts contain non-solicitation provisions restricting one party’s ability to deal with or to solicit or “poach” the other party’s employees without that party’s express consent.

This Employee Solicitation Request Letter is designed for use in situations where such consent is sought. Two situations are envisaged (and catered for in optional paragraphs) – one in which the employee in question approaches the contracting party and the second in which the contracting party wishes to approach the employee.

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
