This Letter - 14 Days’ Notice to Business Tenant of Court Proceedings for Rent Arrears should be used where a landlord intends to take court proceedings against a tenant with rent arrears. It should be used where the Pre-Action Protocol for Debt Claims applies, i.e. where the tenant is a sole trader. It is not strictly necessary to send such a letter where the Protocol does not apply.

Before this letter is sent, the landlord must have sent a Letter of Claim and must have complied with the requirements of the Protocol such as providing information to the tenant and attempting to resolve the matter through discussion with the tenant.

The letter refers to the Letter of Claim and subsequent correspondence and states the landlord’s intention to start court proceedings. It confirms that, in accordance with the Protocol, court proceedings will not be started less than 14 days from the date of the letter.
