This Second Breach Letter can be used where the tenant remains in breach of a term of the lease, despite having received a warning letter from the landlord.
The Letter gives a final deadline for the breach to be remedied and warns that legal action will be taken if the breach is not remedied by that date.
The landlord should keep a copy of the Letter on the tenant’s file. This will be particularly important if the tenant does not remedy the breach as the landlord may need to take legal action against the tenant.
