Company’s Response to Right to Inspect PSC Register Letter

Where a company receives a request to inspect (and copy) its PSC register, it must within 5 working days either comply with the request or apply to the court to prevent the inspection. This is in accordance with section 790P of the Companies Act 2006.

This Company’s Response to Right to Inspect PSC Register Letter can be used by a company to either arrange a mutually convenient time for the inspection to take place or to inform the person making the request that the company does not consider that the inspection is being requested for a proper purpose and the company will be making an application to the court to prevent the inspection.

Note that it is an offence to knowingly or recklessly make a statement that is materially misleading, false or deceptive in a request to inspect and copy a PSC register.

A company must respond to requests to inspect its PSC register as required and it is an offence not to do so. The company must also confirm to those inspecting the register whether the details on the register are current or subject to amendment.
